The Federal Government regulates interstate transportation while the individual states regulate intrastate transportation. Pursuant to the Interstate Commerce Act, the Federal Government regulates common carriers that transport passengers or cargo across state lines. The Federal government has initiated a few set of laws as to the accountability of common carriers to passengers injured while enlisting their service. In most cases, individual State law applies in deciding whether a common carrier is accountable for personal injuries. Although a vast majority of the United States stand by the rule that a common carrier may be responsible for personal injuries to passengers. Some states have regulations stating that while a common carrier is not responsible for completely insuring a passenger's total safety, the carrier owes a high degree of care to its passengers. This translates into the carrier being held liable for injuries sustained by a passenger during transportation that could have been avoided if the carrier had been more conscientiousness. If a personal injury occurs due to the carrier's non-compliance with safety laws, the carrier may be found to have complete liability for personal injuries. Every state and local municipality has specific rules and procedures for bringing a lawsuit against a government entity. If the transportation system is government owned, that entity of government may be liable for injuries or damages resulting from the use of their transportation system.
