Most boating accidents require a report be made to either the state agency regulating boats or to the United States Coast Guard or both. Failure to remain on the scene, render aid, and report the boating accident in a timely manner to the appropriate law enforcement agency is a crime. It is always a good idea to report the incident to your insurance company, and required if a state or federal report was made. When making a report either on paper or to an officer of the law, do not say anything until you have spoken to your attorney. Doing so may reduce recovery options in the future. Try not to make any statement to an insurance adjuster either, without your attorney's counsel and advice. This communication may be very important later on in your claim. Pleasure boat operators are required to follow the same laws while on navigable waters of the United States as are commercial operators. This means that a pleasure craft has to follow the same "rules of the road" as all other boats to avoid collisions as is ocean-going vessels. State laws also regulate such diverse subjects as reckless and careless operation of personal water craft such as "jet skis" and "Sea-doos", mooring to buoys (which is prohibited), "no-wake zones", and interference with navigation. Personal water craft are vessels under the law and require the same respect as larger vessels. Presently, most states do not require a license for the operator of a recreational vessel, and there is no federal law requiring licenses for most recreational vessel owners.
