Las Vegas Auto Accident Injured Nevada Highway Patrolman, Two Others

When a police cruiser stops at the scene of an accident, most people assume that everyone in the area is safe.  That notion was proven wrong in a Las Vegas auto accident yesterday when a Nevada Highway Patrolman stopped to check on a minor accident.  Another vehicle crashed into the scene and injured the patrolman and two other people, one seriously.  The person who was seriously injured was at the scene to provide a witness statement to the original accident.

When these types of accidents arise, the laws of negligence take over and govern any issues of liability.  In short, anyone who is injured in a Nevada auto accident must prove the following:

  1. Duty - Anyone driving on public roads owe those around him or her a duty to not put others in situations of unreasonable risk of harm.
  2. Breach of duty - A plaintiff must show that the defendant in a legal action breached this duty of care by not acting as a reasonable person would have in a similar situation.
  3. Causation - Causation is extremely complicated, and the plaintiff must show that the defendant's actions either directly or indirectly led to the injuries and resulting damages incurred.
  4. Damages - Finally, if all of the other elements are proven, the plaintiff must prove that he or she suffered damages as a result of the negligence of the defendant.

In this situation, it's likely that negligence could be proven, as the driver of the vehicle that hit the police cruiser and injured three people obviously owed them all a duty, likely breached that duty, the breach of which caused the injuries sustained and led to actual damages.
