samharding bike hitandrunA 12-year-old boy was taken to the hospital Friday night after being hit by a driver while riding his bike.

Just before 9 p.m., Javier Gonzalez-Valencia, 25, was driving south on Joyful Street. According to eye witnesses, Gonzalez-Valencia appeared to be driving under the influence. The driver’s red Nissan Titan was swerving severely, crossing in and out of the driver’s lane. The driver then hit several parked cars on the west side of the street before nearing the intersection. At the intersection of Joyful Street and Spiritual Way the Nissan Titan struck the boy on his bike.

After hitting the boy, the driver hit two more parked cars before making a U-turn and fleeing the scene. Police found the Nissan abandoned nearby, and Gonzalez-Valencia at his home soon after. Gonzalez-Valencia failed the field sobriety test and is being held at Clark County Detention Center with no bail on charges of driving under the influence and a hit and run.

The 12-year old boy was taken to University Medical Center with serious injuries, but is alive.

DUI in Nevada

While impaired driving fatalities are declining in Nevada, 27 percent of all 2011 traffic fatalities in Nevada were alcohol-related. In 2012, 14,809 people were arrested for DUI. Thus, DUI incidents are not uncommon.

In Nevada, if an intoxicated driver causes an accident that brings injury or death to another person, the driver faces a serious Category B felony. The punishment involves prison time and fines, with a prison sentence ranging from 2 to 20 years in state prison and fines ranging from $2,000 to $5,000.
