Duties of driver of motor vehicle to pedestrian. NRS 484.3245
A driver of a motor vehicle shall:
1. Exercise due care to avoid a collision with a pedestrian;
2. Give an audible warning with the horn of the vehicle if appropriate and when necessary to avoid such a collision; and
3. Exercise proper caution upon observing a pedestrian on or near a highway, street or road or in or near a school crossing zone marked in accordance with NRS 484.366 or a marked or unmarked crosswalk.
This Nevada statute set forth the duties of a driver of a motor vehicle to pedestrians. A driver must exercise due to care to avoid a collision with a pedestrian. Give audible warnings of the vehicle where appropriate and necessary to avoid a collision. A driver must exercise caution upon observing a pedestrian. A driver who violates this statute may be deemed by the court to have committed “negligence per se”.
