Right of Way: Definition (Nev. J.I. 5.02)

The term “right of way” as used in these instructions means the right of one vehicle or pedestrian to proceed in a lawful manner in preference to another vehicle or pedestrian, approaching under such circumstances of direction, speed and proximity as to give rise to danger of collision unless one gives way to the other.

The above instruction is used in conjunction with any other right of way instructions. NRS 484.315 deals with instances in which vehicles are approaching or entering an intersection. Left turn situations are governed by NRS 454.317. NRS 484.319 covers cases in which vehicles enter an intersection through a stop or yield entrance. Other right of way statutes are NRS 484.321 (vehicle entering highway from private way); NRS 454.322 (vehicle entering controlled access highway); NRS 454.323 (emergency vehicles); NRS 484.325(1) pedestrians in crosswalk without traffic control devices); NRS 484.325(2) (pedestrians suddenly leaving curb or other place of safety); NRS 484.325(4) (pedestrians in crosswalk in which “Walk” and “Don’t Walk” signals are in place); NRS 484.327 (pedestrians crossing at other than crosswalk); and NRS 484.328 (blind persons).
