The VA has been under extreme scrutiny at both the federal and state level after a family filed a lawsuit against the Nevada State Veterans Home. Three weeks ago Robert Robinson, a former Nevada legislator and optometrist, died from being left outside in extreme heat by the staff. The lawsuit is against the facility, the administrator and unnamed defendants. The lawsuit “is a civil rights wrongful death/survival action arising from defendants’ deliberate indifference and negligence resulting in the wrongful death of Dr. Robert Robinson.”
Dr. Robert Robinson was found suffering from second-degree burns on his legs and other parts of his body. He was wearing only shorts at the time. His death certificate stated that the cause of death was due to “sepsis, cellulites, cutaneous burns and prolonged environmental health exposure.”
Nursing home negligence is a growing problem in the United States, according to data gathered from various sources. Unfortunately, there is not a central clearinghouse for information on nursing home abuse, and much of this abuse is never reported to authorities.
The National Center on Elder Abuse estimates that at least 10 percent of all nursing home residents experience some form of abuse other than financial abuse. If stealing and other forms of financial abuse are included, the number may be as high as one in three.
The wrongful death of Robert Robinson was a devastating event for his family and friends. However, there are many other abuse, neglect and even wrongful death nursing home cases about which we never hear. It is important to fight for justice and hold those responsible who abuse our elderly in order to put an end to the negligence.
A wrongful death lawsuit may be the way to hold nursing home staff and owners accountable when their negligence leads to the death of another human being. If you have lost a loved one and suspect nursing home abuse or negligence, you owe it to yourself and others to take action.
